I. Flower Availability & Substitutions

All custom flower arrangements are handcrafted using the freshest seasonal flowers available. In the rare event of supply limitations, substitutions of equal or greater value may be made without prior notice. Quality and design integrity will always be maintained.

II. Delivery Terms & Timing

We offer same day flower delivery for eligible orders placed before 2 PM EST. Delivery times are estimates and may vary due to weather, traffic, or other unforeseen issues.

• Service Area: We serve Miami-Dade and nearby areas. Orders with incorrect addresses may be delayed or canceled.
• Missed Deliveries: If the recipient is unavailable, we will attempt redelivery or arrange pickup.
• Delivery Liability: We are not responsible for failed deliveries due to incorrect or incomplete addresses.

III. Order Cancellations & Changes

Orders may be changed or canceled within 24 hours if processing has not begun. Same-day orders are non-cancellable once preparation has started. Change requests must be submitted in writing to support@flower-delivery.net.

IV. Refund Policy

All sales are considered final. However, refunds or credits may be granted in limited cases, such as:

• Wrong product delivered
• Visible damage at the time of delivery
• Product fails freshness standard (reported within 12 hours)

We do not offer refunds for delays caused by couriers, weather conditions, or approved substitutions.

V. Art Dessert Atelier and Edible Products

Made-to-Order Products

Art Dessert Atelier products are individually handcrafted to order. Unless otherwise stated on the product page, customers must place orders at least 2–3 days in advance. Same-day delivery is not available for Art Dessert Atelier products.

Production and delivery dates remain subject to order acceptance, ingredient availability, product availability, delivery capacity, and confirmation by Miami Flower Delivery.

Manufacturer and Seller Information

Art Dessert Atelier edible products are handcrafted by Art Dessert Atelier and offered, sold, and delivered through Miami Flower Delivery, unless otherwise stated on the individual product page or packaging.

Product specifications, ingredients, allergen declarations, shelf-life information, and storage instructions are based on information supplied and confirmed by the product manufacturer. Miami Flower Delivery may update a product page when the manufacturer changes a recipe, flavor, ingredient, packaging material, or production method.

Ingredients and Allergens

Customers must review the complete ingredient and allergen information shown on the product page and supplied with the physical product before consumption.

Some Art Dessert Atelier products contain egg or other major food allergens. Product-specific allergen information will be displayed on the relevant product page and packaging.

Products may be prepared in a kitchen or facility where other common food allergens are handled. Cross-contact cannot be completely excluded. Customers with known or severe allergies must contact Miami Flower Delivery before placing an order and should not rely only on general dietary descriptions or marketing statements.

Dietary statements such as dairy-free, gelatin-free, flour-free, or free from artificial colors or flavors apply only to the specific product for which they are expressly stated. Such statements do not constitute a medical recommendation or a guarantee that allergen cross-contact has not occurred.

The customer ordering a product for another person is responsible for communicating all relevant ingredient, allergen, storage, and handling information to the recipient before consumption.

Product Information and Handcrafted Variations

Because edible floral products are made by hand, photographs are illustrative. Shape, size, color, flavor distribution, decoration, arrangement, ribbon style, ribbon color, and packaging details may vary slightly while preserving the overall character and presentation of the product.

Flavor and ribbon selections are subject to availability. When a requested ribbon color, material, printed message, flavor, or decorative detail is unavailable, a comparable presentation may be used. Customers must contact us before ordering when a particular detail is essential.

Storage, Handling, and Shelf Life

Customers and recipients must follow all storage, handling, refrigeration, room-temperature, and best-by instructions displayed on the product page or supplied with the product.

After successful delivery or pickup, the recipient assumes responsibility for proper storage and handling. Miami Flower Delivery is not responsible for deterioration caused after successful delivery by delayed collection, unattended delivery, improper storage, exposure to prolonged excessive heat, direct sunlight, excessive humidity, contamination, damaged packaging caused by the recipient, or failure to follow the supplied instructions, except where otherwise required by law.

A product should not be consumed if it is past its stated best-by date or if the product or packaging appears damaged, contaminated, tampered with, or otherwise unsuitable for consumption.

Delivery and Recipient Responsibility

The customer is responsible for providing complete and accurate delivery details and ensuring that the recipient or another authorized person is available to receive the product.

Miami Flower Delivery may decline to leave an edible product unattended when environmental or location conditions could reasonably affect product quality or safety. Additional delivery, rerouting, return-to-studio, or redelivery fees may apply when delivery cannot be completed because of inaccurate information or recipient unavailability.

Edible and Non-Edible Elements

Only the portions of a product expressly intended for consumption are edible. Paper cups, wrappers, boxes, ribbons, labels, cards, supports, containers, and other packaging or presentation materials must not be consumed.

Cancellations

Because Art Dessert Atelier products are made to order, cancellation or modification requests must be received before production begins. Once ingredients have been prepared, the product has entered production, or customized presentation work has begun, the order may not be canceled, changed, or refunded.

Product Issues and Claims

If an edible product arrives damaged, incorrect, incomplete, or appears unsuitable for consumption, the recipient must not consume it. The customer must contact Miami Flower Delivery as soon as possible and no later than 12 hours after delivery or pickup, providing photographs of the product, packaging, label, and condition upon receipt.

Depending on the circumstances and applicable law, an approved claim may result in replacement, store credit, partial refund, or refund to the original payment method.

Limitation of Responsibility

To the fullest extent permitted by applicable law, Miami Flower Delivery is not responsible for indirect, incidental, special, or consequential loss resulting from the customer’s or recipient’s failure to review disclosed ingredients and allergens, provide accurate delivery information, receive the order promptly, or follow the supplied storage and handling instructions.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, inaccurate mandatory food labeling, or any other liability that cannot legally be excluded or limited.

VI. Pricing & Premium Services

We specialize in high end floral arrangements using rare and premium blooms such as orchids and imported roses. Most bouquets start at $250. For events and wedding flower delivery, please contact us at least 10 days in advance to ensure availability.

VII. Payments & Security

We use SSL encryption and follow PCI-DSS standards to protect your data. All payments are processed securely through third-party providers. We do not store any credit card information.

VIII. Intellectual Property

All site content — including text, images, product names, and layouts — is the intellectual property of Miami Flower Delivery. Unauthorized use or duplication is prohibited.

IX. Jurisdiction

These Terms are governed by Florida law. All disputes shall be resolved through the courts of Miami-Dade County, Florida.
